Welcome to Tenor ("Tenor," "Company," "we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of the Tenor website, mobile application, kiosks, products, and services (collectively, the "Services").

By creating an account, accessing the Services, or placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Services.

1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account and use the Services. By using the Services, you represent and warrant that you meet these requirements.

2. Account Registration
You may be required to create an account to use certain features of the Services.
You agree to:

• Maintain the security of your account credentials

• Promptly update any account information that changes

• Accept responsibility for all activities that occur under your account

Tenor reserves the right to suspend or terminate accounts that violate these Terms.

3. Orders and Payments
All orders are subject to product availability.
By placing an order, you authorize Tenor to charge the payment method associated with your account for the total purchase amount, including applicable taxes and fees.
Prices, products, promotions, and availability are subject to change without notice.
Tenor reserves the right to refuse or cancel any order at its sole discretion.

4. Product Availability
Product selection may vary by kiosk location.
Product images displayed in the app or website are for illustrative purposes only and may differ from actual products.
Tenor makes reasonable efforts to ensure inventory accuracy but does not guarantee that all displayed products will be available at all times.

5. Pickup Procedures
Customers are responsible for retrieving their orders within the designated pickup period.
Failure to retrieve an order within the applicable pickup window may result in order cancellation or disposal of perishable items without refund.
Tenor reserves the right to require identity verification, QR code verification, or other authentication procedures prior to releasing orders.

6. Food and Product Safety
Customers are responsible for reviewing product packaging, ingredients, nutritional information, allergen warnings, expiration dates, and usage instructions before consumption or use.
Tenor is not responsible for allergic reactions, dietary sensitivities, or misuse of products.

7. Returns and Refunds
Due to the nature of food and consumable products, certain items may not be eligible for return.
If you experience an issue with an order, please contact Tenor customer support within 48 hours of pickup.
Refunds and credits may be issued at Tenor's sole discretion.

8. Prohibited Conduct
You agree not to:

• Use the Services for unlawful purposes

• Attempt to interfere with kiosk operations

• Tamper with Tenor equipment

• Access unauthorized portions of the Services

• Reverse engineer or attempt to extract software, source code, or proprietary information

• Engage in fraudulent activity

Violations may result in account suspension, termination, or legal action.

9. Intellectual Property
All content, trademarks, logos, software, designs, text, graphics, and other materials associated with Tenor are owned by Tenor or its licensors and are protected by applicable intellectual property laws.
No rights are granted except as expressly provided in these Terms.

10. User Feedback
Any feedback, suggestions, recommendations, or ideas submitted to Tenor may be used by Tenor without restriction or compensation.

11. Service Availability
Tenor does not guarantee uninterrupted operation of the Services.
Services may be temporarily unavailable due to maintenance, technical issues, inventory shortages, power outages, internet disruptions, weather events, or circumstances beyond Tenor's control.

12. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TENOR DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TENOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.
TENOR'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO TENOR FOR THE APPLICABLE ORDER GIVING RISE TO THE CLAIM.

14. Indemnification
You agree to defend, indemnify, and hold harmless Tenor, its affiliates, officers, directors, employees, contractors, and agents from any claims, damages, liabilities, losses, costs, or expenses arising from:

• Your use of the Services

• Your violation of these Terms

• Your violation of applicable laws
   

15. Privacy
Your use of the Services is also governed by Tenor's Privacy Policy, which is incorporated into these Terms by reference.

16. Modifications
Tenor may update these Terms at any time.
Updated Terms will become effective upon posting. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles.

18. Dispute Resolution
Any dispute arising from or relating to these Terms or the Services shall be resolved through binding arbitration in Travis County, Texas, except where prohibited by law.
Users waive the right to participate in class actions or class-wide arbitration.
